Recently, Travis J. Tormey represented a man and a woman who were both charged with simple possession of marijuana and possession of drug paraphernalia arising out of an incident in Mendham Township NJ. Thanks to Mr. Tormey, Mendham NJ marijuana charges were dismissed.
The defendants were pulled over for allegedly having a broken tail light. The officer approached the couple’s car and allegedly saw marijuana on the floor of the vehicle. The officer collected the marijuana as evidence, along with a plastic water bottle that allegedly contained marijuana residue. The couple was then placed under arrest.
When Mr. Tormey received the discovery evidence from the prosecution, he saw that the alleged marijuana collected by the arresting officer had actually been tested and had come back negative. In every marijuana case, the State must send the seized drugs to the NJ State Police Lab for testing to prove that the defendant was, in fact, in possession of drugs.

In this case, the State was unable to prove possession of marijuana because the lab result came back negative for any type of controlled dangerous substance (CDS). Because Mr. Tormey saw that the lab report was negative for marijuana, it became impossible for the State to prove that the water bottle had been used as drug paraphernalia. As a result, Mr. Tormey was able to get both charges against his clients dismissed.
