Leader of Narcotics Trafficking Network Charges in NJ
When a defendant is indicted for the crime of being a leader of a drug trafficking network, it is an extremely serious charge. The relevant section of the New Jersey criminal statutes provides, in pertinent part, that:
A person is a leader of a narcotics trafficking network if he conspires with two or more other persons in a scheme or course of conduct to unlawfully manufacture, distribute, dispense, bring into or transport in this State methamphetamine, lysergic acid diethylamide, phencyclidine, gamma hydroxybutyrate, flunitrazepam or any controlled dangerous substance classified in Schedule I or II, or any controlled substance analog thereof as a financier, or as an organizer, supervisor or manager of at least one other person.
Being a leader of a narcotics trafficking network is a crime of the first degree. As a result, upon conviction a person may be sentenced to an ordinary term of life imprisonment, with a minimum of 25 years which must be served before being eligible for parole. Notwithstanding the provisions of subsection a. of N.J.S.2C:43-3, the court may also impose a fine not to exceed $750,000 or five times the street value of the controlled dangerous substance, controlled substance analog, gamma hydroxybutyrate or flunitrazepam involved, whichever is greater.
Penalties for Leading a Drug Trafficking Network in New Jersey
A conviction for being a leader of a drug trafficking ring is a first degree offense. Normally, first degree crimes are punishable by 10 to 20 years in prison. However, the statute mandates a sentence of life in prison, with a mandatory 25 years to be served without the possibility of parole. As such, it is imperative that a defendant avoids being convicted under this section – either through a negotiated plea to a downgraded charge or through a not-guilty verdict at trial.
