Our client was a middle aged mother with no prior criminal record who was arrested and charged with drunk driving (DWI) after leaving a work event in Morristown. She had a few glasses of wine with dinner and was stopped on her way home by the Morristown Park Police. She was given a number of tickets including driving while intoxicated (DWI). However, her breath test results came back at .06% Blood Alcohol Content (BAC) which is below the legal limit in New Jersey of .08% BAC. As a result, it is presumed under the law that she was legally driving with alcohol in her system. However, the State can overcome this presumption if they can show that she was severely impaired and should not have been behind the wheel of a motor vehicle.
In order to do that, the State would rely on the testimony of the police officers involved, the defendant’s performance on the field sobriety tests conducted at the scene of the traffic stop, and the MVR (video) from the police car which shows her demeanor, behavior, speech, etc.
In this case, we were able to convince the prosecutor in the Morristown Municipal Court that he could not prove the DWI charge beyond a reasonable doubt and that he could not overcome the presumption that she was legally driving. She agreed to plead to two other tickets for careless driving and failure to stop at a stop sign and received no license suspension from this incident.
