A DWI is a traffic offense in New Jersey, it is not a criminal offense. If you are convicted of a DWI, the charge goes on your driver’s history abstract just like a speeding ticket or any other traffic violation. The legal limit in New Jersey is .08% Blood Alcohol Content (BAC). If you are caught driving with a BAC over that limit, and that reading is found to be reliable and admissible in court, then you would be convicted of a DWI offense. On a first offense, if your BAC was between .08% and .10%, you would lose your driver’s license for three (3) months. If your reading is over .10% BAC, then you would lose your driving privileges for seven (7) months to one (1) year.
NOTE: Unfortunately, New Jersey does not offer work or provisional licenses. This means that, if you lose your driving privileges in NJ, you lose them for whatever the period of your suspension is. The Judge can give you a temporary driver’s license to drive home from the courthouse but that’s it.
