This was the client’s first DWI offense, so he was subject to significant penalties: up to 30 days in jail; driver’s license suspension for up to 1 year; an $800 fine; and 12–48 hours of alcohol education classes at the Intoxicated Driver Resource Center (IDRC).
The arrest occurred after New Jersey State Police received a call for motorist aid on the side of Interstate 80 in Rockaway Township. When police officers showed up, our client was slumped over the steering wheel in his vehicle. Police checked on our client and saw that he was sweating profusely, had shallow breathing, and was unresponsive to the troopers’ efforts to speak with him. The driver got medical assistance, but he was still incoherent when speaking with the trooper.
Our client was taken to a nearby hospital for medical treatment. Police then said that our client consented to blood testing – despite the fact that he was in an incoherent state. Police used the blood testing to determine whether our client was under the influence of drugs and/or alcohol. The lab report later indicated that the client’s blood alcohol concentration (BAC) was .00 percent. However, the lab reports also showed the presence of unidentified drugs. As a result of the lab results, authorities charged our client with driving under the influence of drugs (DUI).

The State needed to obtain a warrant in order to take blood for a criminal prosecution.
