Expungement of PTI or Conditional Discharge: N.J.S.A. 2C:52-6

An expungement of your Pre-Trial Intervention (PTI) completion or conditional discharge completion is governed by N.J.S.A. 2C:52-6, which provides, in pertinent part:

§ 2C:52-6. Arrests not resulting in conviction

b. Any person who has had charges dismissed against him pursuant to P.L.1970, c. 226, § 27 (C. 24:21-27) [FN1] or pursuant to a program of supervisory treatment, shall be barred from the relief provided in this section until 6 months after the entry of the order of dismissal.

If you were admitted into a diversionary program in New Jersey, such as Pre-Trial Intervention (PTI) or a conditional discharge, and you successfully completed the program, the charges against you were dismissed. However, there is still a record of the original arrest, which will show up on a background check for school or employment opportunities. As a result, is important for you to have that arrest record expunged. You are eligible to apply for an expungement six (6) months after you successfully completed PTI or your conditional discharge.
