Here is an example of a real DWI matter we successfully handled in the Madison Municipal Court for a client who was arrested and charged with DWI in Morris Twp.
The Morris County DWI defense lawyers at our firm successfully had another drunk driving case dismissed, this time in Morris Township NJ. Any disorderly persons offenses, traffic tickets, and DWI charges that arise in Morris Twp. are handled at the Madison Joint Municipal Court. In this case, our client was a professional in his 50’s with a completely clean driving record and was stopped for suspected DWI based on a failure to maintain his lane. After conducting field sobriety tests, such as the walk and turn test and the stand on one leg test, the officer arrested our client and charged with him DWI. When he took him to the station and placed him on the Alcotest 7110 breath testing device, the client successfully provided two breath samples (which is required in every case). In this case, his two readings were below the legal limit in New Jersey (which is .08% BAC) at .073% and .072%. As a result, his recorded breath test result is a .07% BAC.
However, this does not end the case. The prosecutor can still choose to prosecute the case based on the observations of the police officer and the client’s performance on the field sobriety tests. Luckily, Mr. Tormey, after reviewing the video evidence and the police reports, was able to convince the prosecutor that he could not proceed on the observations only and could not prove the case in court beyond a reasonable doubt. As a result, the State agreed to dismiss the DWI charge without the necessity of a trial.
The client was facing a DWI on his driving history, a three month driver’s license suspension, fines, insurance surcharges, and DMV surcharges and was able to avoid all of these penalties when the DWI was dismissed in court. This was a great result for our client and the Tormey Law Firm.
