Mr. Tormey examined the state’s evidence and determined that there was an issue with the Alcotest documents and calibration records that were provided. Mr. Tormey is certified to operate the Alcotest 7110 breath testing device in NJ, just like the police officers who use the machine to test suspected drunk drivers. In this case, we sent the records to our DWI defense expert, a retired NJ state trooper, who rendered an expert report to the court challenging the reliability of the breath test result in this case. Based on this report, the breath reading was suppressed and the client avoided a 7 month to one year license suspension as well as the ignition interlock device on her motor vehicle. She lost her driving privileges for three months instead.
