Travis Tormey recently represented a client in the Essex County Superior Court on a shoplifting charge. Mr. Tormey’s client was accused of shoplifting from two different stores in the Short Hills Mall in Millburn, New Jersey. She was accused of stealing approximately $2,000 in goods. She had no prior criminal record; however, because she was in this country on a green card, a conviction for a theft offense would most likely lead to her deportation from the country. She was also facing three (3) to five (5) years in NJ State Prison if convicted. Shoplifting is considered a “crime of moral turpitude” by immigration which can cause issues for individuals who are not US citizens.

Millburn Shoplifting Defense Attorney Secures Admission into PTI Program

Mr. Tormey was able to convince both the probation department and the prosecutor that his client was a perfect candidate for admission into the Pre-Trial Intervention (PTI) program. PTI is a program for first-time offenders who have never been in trouble with the law before. The program requires the defendant to be placed on probation, complete community service, and remain arrest-free for a period of one to three years. The length of the probationary period is up to the prosecutor and the Judge.

In order to get into PTI, you must apply and pay the application fee which is $75. Then, you will submit your PTI application and you will be interviewed by probation regarding your background and the case. Probation will then create a PTI recommendation which they will provide to the State either recommending the Defendant for PTI or not recommending them for the PTI program. Finally, it is up to the prosecutor if the defendant is a suitable candidate for the PTI program. If you are rejected from PTI, you can appeal to the Judge.

As a result of Mr. Tormey’s skillful defense, the defendant in this case has the opportunity to complete the PTI program. Upon successful completion of the PTI program, the charges against her will be dismissed and she will have no criminal record. This will also allow her to remain in the country because her immigration status will be unaffected. Needless to say, this outcome was a major success for the Law Firm.

Once the client completes PTI, the charges are dismissed and she has no criminal record. Then, she can file an expungement six (6) months are her PTI dismissal in order to expunge the arrest off of her record as well. Once the expungement is granted, she has no record from this incident and it’s like it never happened.
