Travis J. Tormey Fights Aggravated Assault Charges in Essex County, NJ
Travis J. Tormey of the Tormey Law Firm recently represented a client who had been charged with aggravated assault, a third degree indictable felony-level offense. The charges stemmed from a domestic violence incident in East Orange, NJ. Since it was a felony-level case, the charges were sent to the prosecutor at the Essex County Superior Court in Newark, NJ for disposition.
The client’s wife was the only witness to the alleged offense, but she refused to testify against him in court. As a result, our experienced criminal defense attorneys were able to convince the Essex County Prosecutor’s Office to downgrade the charge to simple assault and remand the case back to the East Orange Municipal Court. Getting the charge downgraded was important because simple assault is a disorderly persons offense, not a felony.
