In this case, the alleged victim appeared in court in Parsippany (where the Boonton Municipal Court is held) and told the prosecutor she did not want to proceed with the case. However, it’s not up to her. The State pressed the charges and it’s up to the police officer and the prosecutor how they proceed. The prosecutor agreed to a “carry order” where they carry the charges for 90 days, our client completes anger management classes, and, as long as there are no other incidents between the parties during that period, the case is dismissed at the end.
Then, we appeared in court again with proof of the anger management classes and the victim again confirmed that she wanted the charges dropped. As a result, the judge agreed to dismiss the case completely for our client. We then helped him apply for an automatic expungement to have the arrest removed from his record as well.
