The former chief of police in Parsippany NJ is fighting drunk driving charges stemming from an arrest in January 2016.
The arrest was made around 4:00 a.m. According to authorities, the former deputy chief of the Parsippany Police Department was intoxicated while sitting in the driver’s seat of his car, which was parked in the parking lot of the Parsippany Elks Lodge in Parsippany, New Jersey. The lodge is located on Parsippany Road.
A Parsippany patrol cop spotted the suspect’s vehicle in the parking lot and noticed that the engine was still running, so the officer knocked on the driver’s side window and tried to get the attention of the suspect. However, the suspect was allegedly asleep behind the wheel.
The suspect was subsequently arrested and charged with Driving While Intoxicated (DWI) and Refusal to Submit to a Breath Test.
Now the suspect, who officially retired from the Parsippany Police Department in 2006, is trying to get the DWI charges against him dismissed. His attorney recently appeared in Madison Joint Municipal Court and filed a motion to dismiss.
Depending on the outcome of the case, the suspect could face significant penalties. As set forth by N.J.S.A. 39:4-50, a first offense DWI can result in penalties that include driver’s license suspension for a period of three months, a $400 fine, required attendance at alcohol education classes held by the Intoxicated Driver Resource Center (IDRC), and up to 30 days in jail.
