3rd Degree Aggravated Assault, 4th Degree Weapons Possession Dismissed Morris County
Client Charged with Third Degree Agg Assault, Fourth Degree Possession of Weapon
Case Arising out of Long Hill Township in Morris County NJ
Our client was an 82 year old woman with no prior criminal history who was accused of hitting her husband with her cane in the stomach causing him an injury. However, the alleged victim suffers from dementia and was not a reliable witness for the State. In addition, based on the fact that our client had no criminal record whatsoever and had lived in the community for 50 years without a single issue, Mr. Tormey was able to negotiate a dismissal with the State.
The client was facing two serious felony charges, one third degree aggravated assault which is punishable by 3-5 years in prison if convicted, and a permanent felony charge on her record. In addition, because it is a violent offense, under the No Early Release Act, she must serve 85% of her prison sentence before she could be released on parole. In addition, the 4th degree weapons possession charge was punishable by 18 months in state prison as well.
The prosecutor requested that the defendant undergo some counseling session which she did voluntarily. Upon providing proof of the completion of these counseling sessions, the Morris County Prosecutor’s office administratively dismissed the charges against her.
